A Triumph in Legislation_ Mandatory Board Training Requirement

For years, we have passionately advocated for mandatory training for HOA board members. We’re thrilled to announce that this requirement has finally been passed. 

The Importance of Board Training 

The landscape of community association legislation is constantly evolving, with new laws and regulations introduced each year. These laws significantly impact the communities they govern. Proper education for board members is crucial for understanding the importance and potential effects of these laws on their communities. 

Why Mandatory Training Matters 

Mandatory training equips board members with a comprehensive understanding of their roles and responsibilities, emphasizing the importance of their fiduciary duties. It also highlights the need to rely on professionals in each field, ensuring decisions are well-informed and legally sound. 

Key Components of Board Training 

One vital aspect of this training is the inclusion of an association attorney. Legal expertise can help clarify complex laws and provide a more thorough understanding of the legal landscape. Additionally, I believe this training should be an annual requirement. With laws and regulations frequently changing, board members must stay updated with the latest developments and understand their implications. Ongoing education ensures that board members remain knowledgeable and capable of making informed decisions that benefit their community. 

New Certification Requirements 

Now, all board members of both condominiums and HOAs must: 

  1. Become certified by taking a 4-hour educational course within one year before becoming a board member or within 90 days of becoming a board member. 
  1. Comply within ninety days once elected or appointed to the Board if you are an HOA member. 
  1. Comply with the educational requirement by June 30, 2025, for condo board members who were on the Board on July 1, 2024. 

Failure to comply with these requirements means you can no longer serve on the Board.
