Legislation in Focus_ Examining the Live Local Act's Impact on Community Associations

For centuries, altruism has been a guiding principle, underpinning the foundations of our communities. Helping others, especially in times of need, has always been considered noble. Yet, good intentions don’t always result in positive outcomes, a lesson underscored by the recent implementation of the Live Local Act in Florida. 

As a community association management company, it’s essential to consider the potential implications of the Live Local Act. Introduced to tackle Florida’s pressing housing crisis, this Act, fortified with a hefty $811 million budget, brings forth several developer incentives. However, the provision that curtails local governments from intervening in zoning, density, and height regulations raises concerns. 

Why Community Associations Should Be Concerned: 

  1. Aesthetic Disruption: Many managed communities have cultivated a particular aesthetic over the years. The Act might usher in high-rise buildings that don’t mesh with the existing visual fabric, potentially diminishing property values or community allure. 
  2. Infrastructure Strain: A sudden influx of residents due to large-scale affordable housing projects could strain local resources, from roads to schools. 
  3. Local Autonomy: The Act limits the community’s voice. Residents and their associations may be unable to influence decisions that directly impact them. 
  4. Community Dynamics: A community’s established norms, rules, and dynamics can be disrupted. Associations may need to revisit bylaws and community guidelines to accommodate the changes. 

Cities like Doral and Miami Beach are already pushing back. As advocates for community cohesion and balance, we believe in a more collaborative approach. While the state’s goal to provide affordable housing is commendable, it’s vital to ensure that local community needs and characteristics aren’t sidelined. 

Our stance is not necessarily for or against the Live Local Act. Instead, we aim to highlight the challenges that arise from these blanket-type laws. One-size-fits-all legislation often overlooks the unique intricacies of individual communities. While the broader objective might be noble, it’s crucial to recognize and address the potential unintended consequences locally. As community association managers, we prioritize ensuring that the communities we serve are prepared and informed to navigate whatever changes such legislation might bring.
